Co announces it has reached a preliminary agreement to settle two purported class action lawsuits which alleged, among other things, that the Company improperly documented and enforced break-time and lunch-time periods for hourly retail store employees in the State of California. Under the terms of the proposed settlement, the co will make cash payments of up to $3.5 mln to fully resolve claims by eligible class members. As a result of the proposed settlement, the co estimates that it will record a pre-tax charge of $2.5 mln to $3.0 mln, equivalent to $0.05 to $0.06 cents per diluted share after-tax, in the fourth quarter of 2005. This charge is not included in Guitar Center's previous financial guidance.
